Holyrood restricts access to female toilets for trans women

Trans women will no longer be able to use the women’s toilets in the Scottish Parliament building.

The Scottish Parliament has changed its toilet access policy, restricting the use of women’s toilets to individuals identified as biologically female. The move follows a legal clarification that under the Equality Act 2010, the term “woman” applies to biological sex.

In response, the Scottish Parliamentary Corporate Body (SPCB) has introduced new gender-neutral toilet facilities within the parliament building. These will operate alongside existing male-only, female-only, accessible, and changing places toilets.

Presiding Officer Alison Johnstone explained the decision, saying: “Such clarity is an important element in offering all individuals confidence, privacy and dignity when using our facilities.” She added that the update helps fulfill legal duties while giving building users clearer guidance.

The SPCB confirmed it will consult on potential future changes pending an updated code of practice from the Equality and Human Rights Commission. The newly designated gender-neutral toilets are set to open on Monday.
