A Federal High Court has ruled that Point of Sale agents qualify as Data Controllers and Processors of Major Importance under Nigeria’s Data Protection Act, dismissing a legal challenge and upholding the NDPC’s authority to mandate their registration.
Court Rules PoS Agents Must Register With NDPC
No more dodging the data rules. According to Nairametrics, a Federal High Court has ruled that PoS agents in Nigeria must register with the Nigeria Data Protection Commission, dismissing a suit that sought their exemption.
Justice F.N. Ogazi held that the NDPC acted within its powers under the Nigeria Data Protection Act, ruling that registration strengthens rather than violates the right to privacy. The NDPC has now directed all affected agents to register immediately, warning of “serious legal liabilities” for non-compliance.
Registration fees vary by data processing level — N250,000, N100,000, or N10,000 — depending on whether an entity falls under Ultra High, Extra High, or Ordinary High Level classification.
