The Federal High Court in Lagos has dismissed WASPAN’s suit challenging the FCCPC’s authority to regulate Nigeria’s ₦400 billion airtime and digital lending market.
Court Upholds FCCPC Powers Over Airtime Lending
The Federal High Court in Lagos has affirmed the powers of the Federal Competition and Consumer Protection Commission (FCCPC) to regulate Nigeria’s digital lending market, including airtime credit services, in a ruling expected to reshape oversight of the ₦400 billion industry, according to This Day.
Justice Ambrose Lewis-Allagoa dismissed a suit by the Wireless Application Service Providers Association of Nigeria (WASPAN), holding that the FCCPC’s DEON Regulations are constitutionally valid and do not usurp the Nigerian Communications Commission’s powers. “Concurrency means coexistence, not displacement,” the judge said.
The court discharged four interim injunctions earlier restraining enforcement of the regulations and made no order as to costs, citing the public importance of the case.
