Man deported from Ireland on Nigeria flight wins appeal to return

A poultry factory worker deported to Nigeria earlier this year has won an appeal to return to Ireland and seek asylum, overturning his deportation order.

The man, in his 30s, was among 35 passengers removed on a government charter flight in June. The International Protection Appeals Tribunal accepted fresh evidence that he is a gay man facing persecution in Nigeria, where same-sex relationships are criminalised.

The tribunal found “clear evidence” that he is “wanted by the Nigerian authorities” over a past same-sex relationship, supported by police and criminal records. He said: “I can’t go outside because of the fear and of the threat. I’m afraid where I am, I’m not safe.”

He has been given 10 days to secure a visa and return to Dublin for an International Protection Office meeting but faces delays. His solicitors have sought an extension from the Department of Justice.

The man, who lived in Ireland since 2020, said friends had provided witness statements to support his case. “My situation was true… it’s really, really difficult for me,” he said.

The Department of Justice has not commented.
